The Delhi High Court has declined to entertain a public interest litigation seeking directions to force the Cockroach Janta Party to deposit interim compensation of Rs 5 crore for public disruption. A division bench comprising Acting Chief Justice Nitin Wasudeo Sambre and Justice Sanjay Sharma disposed of the petition, granting the advocate liberty to approach the Supreme Court instead.
The order was issued after the bench took note that the apex court is already seized of similar matters and broader issues connected to recent public demonstrations in the national capital. Solicitor General Tushar Mehta, representing the Central government, informed the court that related legal proceedings are actively being examined by the highest court.
Disruption and Public Compensation Demands
The petition, filed by an advocate, sought strict legal action and the imposition of a collective fine against the political outfit for causing widespread public inconvenience. The plea alleged that the group violated permitted ground conditions during demonstrations in central Delhi, severely affecting daily life, commercial activity, and vehicular movement.
According to the petitioner, the group overstayed its designated timeline at protest venues and expanded its agitation to demand the resignation of constitutional authorities. The filing highlighted that traffic snarls and blockades trapped commuters, office-goers, and schoolchildren while inflicting severe losses on local traders and business establishments.
Call for High-Powered Claims Committee
Beyond requesting an immediate interim deposit of Rs 5 crore, the PIL urged the court to constitute a high-powered independent committee. This proposed body was intended to invite, evaluate, and process compensation claims submitted by affected citizens and local business owners who suffered commercial damages during the agitation.
