Twisha Sharma’s mother-in-law and former judicial officer Giribala Singh on Monday told the Madhya Pradesh High Court that she had called her daughter-in-law a “murderer" over her decision to abort her child in the heat of the moment, but had neither subjected her to cruelty nor abetted her suicide.
Singh’s counsel made the submissions before Justice Ajay Kumar Nirankari during the hearing of her bail plea. He argued that Singh’s anger over the abortion did not establish that she had driven Sharma to take her own life.
The senior counsel said that if Singh and her son, lawyer Samarth Singh, had forced Sharma to undergo an abortion, it would have amounted to cruelty. However, he argued that the circumstances were different in this case.
“The mother-in-law was very upset because the daughter-in-law was not listening to her and had gone through with the act. I would like to know which mother-in-law would be happy about this. Natural reaction would be of anger," the counsel said.
He added that Singh had expressed her displeasure by not speaking to Sharma, describing this as a natural reaction.
‘Murderer’ Remark Made In Heat Of The Moment
Referring to chats in which Giribala Singh allegedly called Twisha Sharma a murderer for proceeding with the abortion, her counsel argued that the remark should not be interpreted as abetment to suicide.

Giribala Singh told the Madhya Pradesh High Court that she called her daughter-in-law a murderer in the heat of the moment over an abortion.
Twisha Sharma was found hanging at her matrimonial home in Bhopal on May 12, five months after marrying lawyer Samarth Singh.
The Central Bureau of Investigation arrested Giribala Singh and Samarth Singh, who were charge-sheeted under Sections 85 and 108 of the BNS.
The Supreme Court stayed the trial on merits while ordering that the bail applications of the two accused be decided within two weeks.
“Both mother-in-law and husband wanted the child, so if she has called her a murderer, does it mean she wants her to commit suicide?" the senior counsel asked.
He said Singh had made the remark in the heat of the moment and later apologised for it.
“All that Giribala has said ‘murderer, murdered, murderer’… it was in the heat of the moment," the counsel submitted.
The defence also argued that the chats appeared to point towards Samarth Singh’s behaviour rather than his mother’s. According to the senior counsel, the messages could suggest that the husband’s conduct was a factor in Sharma’s death.
“I submit that this clearly exonerates Giribala. Whatever is being said is being said against Samarth," he told the court.
The counsel also said Sharma had intended to move to Delhi and had applied for a job there. Challenging the allegation that she had been driven to suicide, he argued that she had not been confined or prevented from going anywhere.
“It is not a case that she was in confinement. It is not a case where she could not go anywhere," he said.
Singh’s counsel also argued that bail should be granted in cases involving offences punishable with imprisonment of up to seven years. Her arguments concluded on Monday.
Twisha Sharma Case
Noida-based Twisha Sharma married Bhopal-based lawyer Samarth Singh after they met through a dating app. Five months into the marriage, she was found hanging at her matrimonial home in Bhopal on May 12.
Her family accused her husband and in-laws of persistent domestic violence and harassment over dowry demands. An FIR was registered at Katara Hills police station under various provisions of the Bharatiya Nyaya Sanhita (BNS) and the Dowry Prohibition Act.
Giribala Singh, a former president of the District Consumer Disputes Redressal Commission in Madhya Pradesh, was initially granted anticipatory bail by a sessions court. The Madhya Pradesh High Court later cancelled the relief after the state government and Sharma’s family challenged the order.
The High Court also directed a second post-mortem examination by a team of doctors from AIIMS Delhi after Sharma’s family sought a fresh examination to establish the exact cause of death.
The Central Bureau of Investigation (CBI) subsequently arrested Giribala Singh and Samarth Singh. After their CBI custody ended on June 2, a Bhopal court remanded both to judicial custody. Their bail applications remain pending.
The two have been charge-sheeted under Sections 85, relating to cruelty and harassment by a husband or his family members, and 108, relating to abetment to suicide, of the BNS.
The Supreme Court recently stayed the trial on merits while issuing notice to the CBI on a petition filed by Sharma’s father seeking transfer of the trial to Delhi. It directed that the bail applications of the two accused be decided within two weeks.
“While trial proceedings on merits shall remain stayed, the bail applications filed by respondent 2 and 3 to be decided within two weeks," the Supreme Court ordered.
