Members of Parliament from the INDIA alliance and citizens gathered in New Delhi on October 31 and passed a resolution calling for the removal of Chief Election Commissioner Gyanesh Kumar. The resolution accuses the Election Commission chief of undermining the electoral process and acting against the constitutional principle of free and fair elections.

The document, described as a resolution for the “public impeachment" of Kumar, lists six charges against him. The allegations include voter roll manipulation, changes to electoral registration rules and the centralisation of control over electoral data.

According to the resolution, the INDIA alliance MPs represent more than 60% of India’s population. It says the action against Kumar is necessary to protect universal adult suffrage under Article 326 of the Constitution.

One of the main allegations concerns the Special Intensive Revision (SIR) of electoral rolls. The resolution claims that the exercise resulted in the deliberate deletion of 13.2 crore voters. It alleges that the process was carried out in a partisan and opaque manner and deprived citizens of their constitutional right to vote.

The INDIA bloc has also accused Kumar of changing Form 6 under the Registration of Electors Rules, 1960, without adequate parliamentary oversight. The resolution claims the change could prevent eligible first-time voters from being enrolled.

Another charge relates to the ECI’s ERONET and ECINET systems. The resolution alleges that control over electoral rolls was centralised at the Election Commission, limiting the ability of local Electoral Registration Officers to add eligible voters.

The document further alleges that Kumar and seven other officials excluded the other two Election Commissioners from key decisions. It claims the two commissioners recorded at least 14 objections to the functioning of the poll body.

The sixth and broadest charge accuses Kumar of failing to act independently as required by the Constitution. The resolution alleges that opposition leaders were denied hearings, that access to the Election Commission was restricted and that some opposition politicians faced disqualification and physical attacks during protests.

It also makes allegations concerning benefits and appointments received by members of Kumar’s family. These claims are presented in the resolution as evidence of alleged favouritism towards the ruling BJP.

The document further alleges that legal protections introduced for the Chief Election Commissioner by the Narendra Modi government in December 2023 were intended to shield Kumar from accountability. It calls for him to be removed immediately and says he should face proceedings for alleged “treason" under the constitutional and legal framework.

The resolution represents the INDIA bloc’s allegations against the Election Commission chief. The charges would require examination under the relevant constitutional and legal processes before they could be established as facts.
